UPINION is a platform where people answer surveys and may receive rewards. We send invites via social networks and email. This Policy applies to our sites and related services.
2. Personal Data we collect and sources
2.1 What is “Personal Data”
“Personal Data” means information relating to an identified or identifiable natural person, alone or combined with other information.
2.2 Data subjects
- Creator: a person or organization that creates/manages surveys on UPINION.
- Respondent: an individual who receives and answers surveys.
- Panelist: a person invited via panel/recruitment partners.
- Visitor: anyone browsing our sites without an account.
2.3 Categories of data
- (a) Contact: name, email, phone provided by you.
- (b) Cookies/trackers: first/third-party cookies for stats, functionality, fraud-prevention and, where lawful, marketing (see Section 6).
- (c) Support: messages submitted to support/sales and call logs.
- (d) Usage: pages viewed, clicks, language, features used.
- (e) Device/Browser: IP, OS, device type, technical identifiers; approximate geolocation inferred from IP.
- (f) Server events: logs with IP, ISP, files accessed, timestamps.
- (g) Referral: source that led you to our site or a guest review.
- (h) Integrations: data needed to connect third-party services you authorize.
- (i) Account/Billing: profile, preferences, timezone/language; billing data where applicable.
- (j) Address book: contacts imported by Creators to send invites (used only per Creator’s instructions).
- (k) Survey content: questions and responses to provide reports/analytics.
- (l) First-party profile: information you add to improve targeting/eligibility.
- (m) Third-party profile: permitted enrichment from public/commercial sources to improve quality and anti-fraud.
3. How we use Personal Data
We rely on consent, contract, legitimate interests, and legal obligations, as applicable.
3.1 Creators
- Consent: non-essential cookies and marketing communications where required.
- Contract: operate accounts, billing, support, features and reporting.
- Legitimate interests: product improvement, metrics, recommendations, security and anti-fraud with safeguards.
- Legal: comply with lawful requests and enforce agreements.
3.2 Respondents/Panelists
- Contract: send invites, avoid duplicates, measure completion, provide support.
- Legitimate interests: quality, usability, aggregated/de-identified analytics and anti-fraud.
- Legal: comply with requests and prevent abuse.
4. Cookies and similar tech
We use strictly necessary cookies and, where lawful, performance, preferences, and marketing cookies. You can manage them in your browser and via our cookie banner. Disabling may impact features.
5. Sharing
- Processors/partners: infrastructure, email/SMS, analytics, payments, fraud-screening, support. We use DPAs and confidentiality terms.
- Per Creator’s instructions: integrations/exports requested by the survey owner.
- Legal: to comply with laws and prevent unlawful activities.
- Corporate events: mergers, acquisitions or restructuring with safeguards.
6. International transfers
Where data leaves your country, we implement appropriate safeguards (e.g., Standard Contractual Clauses, TIAs, technical/organizational measures).
7. Retention
We retain data for as long as needed for the purposes and legal obligations. Creators can delete surveys/data; we may anonymize/aggregate for statistics.
8. Security
We apply proportional technical and organizational measures (encryption in transit, access controls, monitoring and anti-fraud). No platform is 100% secure.
9. Your rights
Depending on your jurisdiction (e.g., GDPR/local laws), you may have rights to access, rectify, delete, port, restrict, object and withdraw consent. Submit requests via the Contact section.
10. Children
Our services are not directed to children without required legal consent. We will delete data inadvertently collected.
11. Changes to this Policy
We may update this Policy and indicate the effective date. Significant changes may be notified through customary channels.
Participation Terms & Conditions
1. Acceptance & Eligibility
By participating you agree to these Terms and our Privacy Policy, and confirm you have legal capacity to do so.
2. Data use authorization
You authorize UPINION to process your data as described in this Policy, including survey operations, stats, anti-fraud, and service improvement.
3. Rewards and Upinion’s decision
Upinion defines the payment method, value, and timing for rewards. Participation does not create any employment, partnership, or agency relationship, regardless of the number of responses. Payouts depend on validation. Invalid responses (e.g., inconsistent, random, copied, automated, or rule-breaking) may yield no reward.
4. Quality, validation, and anti-fraud
We apply validation layers, attention checks, and anti-fraud algorithms. Accounts may be blocked/suspended and responses rejected if fraud, abuse, or violations are suspected.
5. Invites and availability
No guarantee on invite frequency, reward amounts, topics, or eligibility. Surveys may close at any time once quotas are met.
6. Participant conduct
Do not disclose confidential survey content, use offensive language, submit misleading information, violate third-party rights or applicable laws.
7. Intellectual property
Surveys, brands and related content belong to UPINION or licensors. You receive a limited authorization solely to participate.
8. Disclaimers & limitation of liability
Services are provided “as is,” with no warranty of results. To the extent allowed by law, UPINION’s liability is limited to amounts actually paid to you as undisputed rewards.
9. Termination
You may close your account anytime. We may suspend/terminate access for violations, fraud, legal orders, or security risks.
10. Governing law & venue
Local laws of your territory apply. Disputes will be resolved in the competent courts unless mandatory rules indicate otherwise.
